TRAVELFUNZ TERMS & CONDITIONS (T&C)

(Applicable to all TravelFunz products: Group Tours, Private Tours, Free & Easy Packages, Hotel Bookings, Air Tickets, Ferry Tickets, Ground Arrangements, Activities, Add-ons and Related Travel Services)

IMPORTANT NOTICE:
By making any reservation with TravelFunz (“the Company”, “we”, “our”), you (“Customer”, “Traveller”, “you”, “your”) acknowledge that you have read, understood and fully accepted these Terms & Conditions (“T&C”).
These T&C form a legally binding agreement between you and TravelFunz.
Please read carefully before making any payment.

1. GENERAL PROVISIONS & DEFINITIONS

1.1 These T&C apply to all travel products and services offered or arranged by TravelFunz, including but not limited to package tours, private tours, group tours, hotel bookings, air tickets, ferry tickets, ground arrangements, transfers, attraction tickets and activity bookings.

1.2 The “Booking Confirmation”, “Invoice”, “Itinerary” or “Service Voucher” collectively form part of these T&C. In the event of inconsistency, these T&C shall prevail.

1.3 “Third Party Service Providers” refer to airlines, ferry operators, hotels, land operators, transport companies, insurance companies, restaurants, attraction operators and any supplier not owned, managed or controlled by TravelFunz.

1.4 TravelFunz acts solely as an intermediary between Customers and Third Party Service Providers. We are not responsible for their decisions, policies, delays, errors or operational limitations.

1.5 “Force Majeure” includes but is not limited to: natural disasters, pandemics, government regulations, border closures, strikes, riots, war, terrorism, transport failures, supplier insolvency or any event beyond reasonable control.

2. PACKAGE COMPONENTS, INCLUSIONS & EXCLUSIONS

2.1 Package components shall be based on the final confirmed itinerary.

2.2 Unless explicitly stated, the following are not included:

•Airport taxes, fuel surcharges, airline insurance surcharges, port taxes

•Visa fees, travel insurance premiums

•Hotel deposits, minibar, room service, personal expenses

•Laundry, telephone charges, beverages

•Excess baggage fees, seat selection fees

•Tips for guides, drivers, leaders and porters

•Optional tours and free-time expenses

•Government-imposed taxes introduced after booking

2.3 Any additional cost caused by traveller-related issues (late arrival, refusal to board, passport problems, immigration rejection) shall be borne by the Customer.

3. PRICE ADJUSTMENTS, EXCHANGE RATE & SURCHARGES

3.1 Prices may be adjusted due to:

•Exchange rate fluctuations

•Airline fuel surcharge increases

•Supplier price changes

•Newly implemented taxes or mandatory charges

3.2 Customers must pay any required top-up. Failure to do so will be deemed a cancellation.

4. RESERVATION, DEPOSIT & SUBMISSION OF TRAVELLER INFORMATION

4.1 A reservation is considered valid only when BOTH conditions are fulfilled:

(a) Deposit is paid; and

(b) Traveller information (passport details & full personal details) is submitted within 3 calendar days.

4.2 Deposit amount per traveller:

  • China: RM/SGD 750

  • General destinations: RM/SGD 1000

  • Nordic/Africa/Exclusive Flights: RM/SGD 2000

  • South America: RM/SGD 4000

4.3 Deposits are strictly non-refundable.

4.4 Failure to submit information within the deadline will be deemed cancellation.

5. CONFIRMATION, MINIMUM GROUP SIZE & FINAL PAYMENT

5.1 Payment of deposit does not constitute confirmation. The tour is only confirmed when TravelFunz issues a formal “Final Tour Confirmation”.

5.2 TravelFunz reserves the right to reject bookings if the minimum group size is not met.

5.3 Final payment must be made 30 days before departure.

5.4 Late payment is considered cancellation, with the cancellation date falling on the day after the payment deadline.

6. CANCELLATION BY CUSTOMER

6.1 Customers may cancel anytime by written notice. Cancellation fee per traveller:

6.2 Additional charges apply:

 

  • Non-refundable air tickets / hotel / visa costs

  • Administrative fee RM/SGD 250

 

 

 

6.3 Any change of name (non-typo), change of date or switching to another tour = treated as cancellation.

7. CANCELLATION BY COMPANY

TravelFunz may cancel a tour due to:

  • Force Majeure

  • Supplier inability or refusal to provide service

  • Insufficient participants

  • Safety or operational concerns

TravelFunz may, at its sole discretion, offer one of the following:

(a) Transfer to another tour (fare difference applies)

(b) Credit note for future use

(c) Full refund of payments received

No further compensation will be provided.

8. AMENDMENTS BY CUSTOMER

8.1 Requests must be made at least 30 days before departure.

8.2 All penalties/payments/administrative fees are borne by the customer.

8.3 Airline date/time changes are generally not permitted.

9. AMENDMENTS BY COMPANY

9.1 TravelFunz may adjust the following due to operational or safety reasons:

  • Flight schedule

  • Hotel of similar or equivalent standard

  • Itinerary sequence

  • Replacement of attractions or activities

9.2 Such adjustments do not constitute grounds for refunds or claims.

9.3 If an attraction or activity cannot be carried out, a refund of the equivalent value of that component will be provided (value determined solely by TravelFunz).

10. PANDEMICS & GOVERNMENT RESTRICTIONS

10.1 Any loss arising from the following shall be borne by the customer:

  • Positive test results

  • Quarantine orders

  • Government border closures

  • Travel restrictions

  • Close-contact notices

  • Denial of boarding due to health protocols

10.2 Customers are strongly advised to purchase travel insurance with pandemic protection.

11. TRAVEL DOCUMENTS, VISA & INSURANCE

11.1 Passports must be valid for at least 6 months.

11.2 Visa rejection = deemed cancellation on the departure date.

11.3 TravelFunz may assist with visa applications but does not guarantee approval.

11.4 Comprehensive travel insurance is strongly recommended.

12. AIRLINE & TRANSPORT RESPONSIBILITY

12.1 Airline rules supersede these T&C.

12.2 Airline-related issues (delays, cancellations, baggage loss/damage) fall under the airline’s responsibility.

12.3 Additional costs for rebooking or alternative arrangements shall be borne by the customer.

13. ACCOMMODATION POLICIES

13.1 Triple rooms may consist of rollaway beds/sofa beds.

13.2 Hotel deposits are payable by customers.

13.3 Check-in/check-out times follow hotel rules.

13.4 Special room requests are subject to availability.

14. GROUP CONDUCT & NO-SHOW

14.1 Customers must assemble punctually.

14.2 Failure to appear at meeting points = voluntary forfeiture.

14.3 No refunds for missed activities.

15. TRANSPORT, DRIVERS, GUIDES & TOUR LEADERS

15.1 Seat rotation may apply.

15.2 Tour leaders/guides may exercise authority in maintaining safety and order.

16. SHOPPING, OPTIONAL TOURS & FREE TIME

16.1 Shopping activities are voluntary.

16.2 TravelFunz is not responsible for product quality, authenticity, warranty or after-sales matters.

16.3 High-risk activities require customers to assume full responsibility.

17. SPECIAL TRAVELLERS

17.1 Minors must be accompanied by adults with legal consent forms.

17.2 Pregnant travellers must provide a valid medical certificate. Refusal to board = no refund.

17.3 Travellers with medical conditions must declare prior to booking.

18. MEDICAL RISK & EMERGENCY MEASURES

18.1 TravelFunz may arrange emergency assistance (e.g., hospital transport).

18.2 All related expenses are borne by the customer.

18.3 TravelFunz is not liable for medical outcomes.

19. DATA PROTECTION & MEDIA USAGE

19.1 Personal data is managed in accordance with the Malaysia Personal Data Protection Act (PDPA).

19.2 Photos and videos taken during tours may be used for marketing purposes.

19.3 Published materials will not be removed retroactively.

20. LIABILITY LIMITATION & CUSTOMER INDEMNITY

20.1 TravelFunz is not liable for losses unless caused by gross negligence.

20.2 Maximum liability = total amount paid by the customer.

20.3 Customers shall indemnify TravelFunz for any losses/damages caused by them.

21. REFUND METHODS & TIMELINE

21.1 No refunds except as explicitly stated in these T&C.

21.2 Processing time:

  • Cash/Transfer: 2–4 weeks

  • Credit Card: 4–6 weeks

  • Credit Note: 4–6 weeks

Delays may occur during peak seasons.

22. PAYMENT METHODS & SERVICE FEES

22.1 Accepted payment methods: cash, bank transfer, credit card, e-wallet, valid voucher.

22.2 Credit card payments may incur processing fees.

23. NOTICES & TIME CALCULATION

23.1 All communication is deemed valid when sent via email or official messaging system.

23.2 Time calculations follow Malaysia local time.

24. DISPUTE RESOLUTION & GOVERNING LAW

24.1 Disputes shall first undergo amicable negotiation → mediation →

if unresolved, submitted to courts of Malaysia (Johor jurisdiction).

24.2 These T&C are governed by Malaysia law.

25. NON-TRANSFERABILITY, SEVERABILITY & THIRD-PARTY RIGHTS

25.1 Customer rights and reservations are non-transferable.

25.2 Invalid provisions shall not affect remaining clauses.

25.3 No third party shall have rights under this agreement.

26. T&C UPDATES & FINAL INTERPRETATION RIGHTS

TravelFunz reserves the right to amend, update or remove any part of these T&C at any time.

The latest version on the official platform shall prevail.

The Company retains full and final interpretation rights.
